In Texas, you can file for either no-fault or fault-based divorce. No-fault divorce is legally called “insupportability,” and it is the more common path. However, there are several fault-based grounds for divorce. These include cruelty, adultery, abandonment, and conviction of a felony.
A fault-based divorce may also be granted if the couple has lived apart for at least three years or if one spouse has been confined to a mental hospital for at least three years and their condition is unlikely to improve.
Unless your case involves family violence, you must wait at least 60 days from your filing date to finalize your divorce. Complex, contested divorces may take months or even years to finalize.
If a spouse comes into the marriage with property or debt, it generally remains the separate property of that spouse. Assets accumulated and debts incurred during the marriage are community property.
The courts will equitably divide community property, meaning they aim to distribute assets fairly, though not necessarily 50/50. The spouses keep their respective separate property.
Custody decisions by Texas courts are based on the best interests of the child. If both parents are willing and able to care for the child, the court will usually award joint custody.
